Processing your issue
- Upon receipt, a TIES registration number will be allocated to your issue and we will advise you of this number in writing.
- Details of your issue will be made publicly available at www.ties.gov.au. Personal details are not displayed.
- An initial assessment will be undertaken of your issue by the Treasury and the Tax Office. The purpose of this assessment is to gain a clear understanding of the issue(s) raised. Where necessary we may contact you to clarify your issue(s).
- Issues will be reviewed by a working group of the Board of Taxation. This working group is chaired by Keith James, a member of the Board of Taxation, and comprises Gordon Cooper, Teresa Dyson, Michael Hay and Ken Spence. Their role is to provide private sector input into the analysis and prioritisation of issues submitted to TIES.
- We will advise you in writing whether your issue can be dealt with by TIES. Where your issue is ‘outside the scope of TIES’ we will tell you why and where possible we will suggest other avenues where you might receive further assistance.
- In some cases, issues that are ‘outside the scope of TIES’ will be referred onto ATO Complaints. You will be given an opportunity to opt out of this process (see - Frequently asked questions).
- In some cases, issues that are ‘outside the scope of TIES’ will be referred to the ATO for Interpretative Advice. You will be given an opportunity to opt out of this process (see - Frequently asked questions).
- We will update the online TIES Register, available at www.ties.gov.au with details of how issues are progressing on a regular basis. These updates will include information about when issues are finalised (Legislation passed, etc.)
- We will seek to find the best solution to your issue, either by raising with the Government the possibility of changing the law or by the Commissioner of Taxation implementing a proper administrative response using his powers under the existing law.
- We will provide you with further advice in writing once the Tax Office or the Government has decided a response to your issue along with details of how the issue was resolved.
